1. Geltungsbereich / Scope of Application
DE: Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Dienstleistungen, die von Lemuria Coaching über die Website https://lemuria-coaching.org angeboten werden.
EN: These General Terms and Conditions (GTC) apply to all services offered by Lemuria Coaching via the website https://lemuria-coaching.org .
2. Vertragsgegenstand / Subject of the Agreement
DE: Lemuria Coaching bietet Coaching im Bereich Gesundheit, Achtsamkeit und Persönlichkeitsentwicklung an. Coaching ersetzt keine medizinische oder psychotherapeutische Behandlung. Die Verantwortung für die eigene körperliche und psychische Gesundheit liegt bei den Kund:innen.
EN: Lemuria Coaching provides coaching in the fields of health, mindfulness, and personal development. Coaching does not replace medical or psychotherapeutic treatment. Clients remain fully responsible for their physical and mental health.
3. Vertragsschluss / Conclusion of Contract
DE: Die Darstellung der Angebote ist unverbindlich. Mit der Buchung geben Kund:innen ein verbindliches Angebot ab. Der Vertrag kommt zustande, sobald Lemuria Coaching die Buchung schriftlich (per E-Mail) bestätigt.
EN: The presentation of services is non-binding. By booking, the client submits a binding offer. The contract is concluded once Lemuria Coaching confirms the booking in writing (via email).
4. Preise und Zahlungsbedingungen / Prices and Payment
DE: Alle Preise sind in EUR angegeben. Die Zahlung ist vor Beginn des Coachings fällig. Akzeptierte Zahlungsmethoden: Banküberweisung, PayPal, Stripe.
EN: All prices are stated in EUR. Payment is due before the start of the coaching. Accepted payment methods: bank transfer, PayPal, Stripe.
5. Widerrufsrecht (EU-Verbraucher:innen) / Right of Withdrawal (EU Consumers)
DE: EU-Verbraucher:innen haben ein 14-tägiges Widerrufsrecht. Das Widerrufsrecht erlischt, wenn die Dienstleistung vollständig erbracht wurde und Kund:innen zuvor ausdrücklich zugestimmt haben, dass mit der Leistung vor Ablauf der Widerrufsfrist begonnen wird.
EN: EU consumers have a 14-day right of withdrawal. The right of withdrawal expires once the service has been fully performed and the client has expressly agreed to the service starting before the withdrawal period ends.
6. Durchführung der Coachings / Execution of Coaching Sessions
DE: Termine werden individuell vereinbart. Bei Verspätungen verkürzt sich die Session entsprechend. Absagen sind mindestens 24 Stunden vorher mitzuteilen, andernfalls wird das volle Honorar fällig.
EN: Sessions are scheduled individually. Delays shorten the session accordingly. Cancellations must be made at least 24 hours in advance; otherwise, the full fee is due.
7. Haftung / Liability
DE: Lemuria Coaching haftet nicht für Umsetzungsergebnisse des Coachings und gibt keine Heil- oder Erfolgsversprechen. Die Haftung ist auf Vorsatz und grobe Fahrlässigkeit beschränkt. Bei einfacher Fahrlässigkeit haftet Lemuria Coaching nur für wesentliche Vertragspflichten, begrenzt auf den vorhersehbaren Schaden.
EN: Lemuria Coaching is not liable for the implementation results of the coaching and does not provide any guarantees of healing or success. Liability is limited to intent and gross negligence. For slight negligence, liability applies only to essential contractual obligations and is limited to foreseeable damages.
8. Geistiges Eigentum / Intellectual Property
DE: Alle bereitgestellten Unterlagen, Skripte, Videos und Materialien sind urheberrechtlich geschützt. Eine Weitergabe oder Vervielfältigung ohne schriftliche Zustimmung ist unzulässig.
EN: All provided documents, scripts, videos, and materials are protected by copyright. Distribution or reproduction without prior written consent is prohibited.
9. Datenschutz / Data Protection
DE: Die Verarbeitung personenbezogener Daten erfolgt gemäß der Datenschutzerklärung unter https://lemuria-coaching.org/datenschutz .
EN: The processing of personal data is carried out in accordance with the privacy policy available at https://lemuria-coaching.org/datenschutz .
10. Schlussbestimmungen / Final Provisions
DE: Es gilt das Recht der Bundesrepublik Deutschland, sofern zwingende Verbraucherschutzvorschriften dem nicht entgegenstehen. Gerichtsstand ist der Sitz von Lemuria Coaching, sofern der/die Kund:in Unternehmer:in ist. Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen unberührt.
EN: The law of the Federal Republic of Germany applies, unless mandatory consumer protection provisions dictate otherwise. The place of jurisdiction is the registered office of Lemuria Coaching, provided the client is a business entity. If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected.
